New York Gov. Kathy Hochul signed S5935A on December 5, 2025, making it Chapter 605. The enacted measure took effect immediately.
The law covers online games that use a dual-currency payment system allowing cash or cash-equivalent prizes and simulate casino-style gaming. New York's Gaming Commission determines what constitutes a dual-currency system under the statute.
S5935A prohibits operating, conducting or promoting games within that definition. It also bars listed financial institutions, payment processors, geolocation providers, gaming-content suppliers, platform providers and media affiliates from supporting covered activity.
The law authorizes fines of $10,000 to $100,000 for each violation, along with consequences for gaming licenses. Enforcement authority rests with the Gaming Commission, State Police and attorney general.
For players, the immediate effective date meant the new restrictions applied from the day of signing. The statute did not set a universal account or redemption deadline.
A subsequent VGW settlement set out a limited redemption route for a defined group of former New York players.
